Do I need a building permit for a fence? Yes. All fences require building permits. Fence permits currently cost a flat fee of $ 25.00.
Is a fence permit required when making repairs or replacing an existing fence? As long as the original fence had a permit when constructed, no permit is required unless the repair or replacement changes the height or layout of the fence. In cases where no permit existed for the original fence, a new permit must be obtained before commencing repair or replacement. Does a temporary fence require a permit? Yes. Can a fence be located in a yard setback?Yes. Fences are exempt from setback requirements, except when impairing safe sight lines at intersections (See clear view triangle) as determined by the City Planner and subject to applicable height limits.
What is the maximum fence height in my side and rear yard? Fences located within the side and rear yard setbacks may not exceed six feet in height from existing grade.
How is the fence height measured? The height of the fence is measured from the top of the fence, including posts, to the existing ground level directly below the section of fence being measured. A two inch anti-warping gap is allowed to be excluded from this measurement.
Can I build a berm, mound, or small hillock to raise the height allowance for my fence? No. In cases where this is done, fence heights will be measured from where the original grade was. In cases where this is done, the inspector may require shortening or removal of the fence at the owner’s expense.
Can the fencing height exceed the maximum height limit? No, except in special cases. See the Zoning Code.
What is the maximum fence height in the front yard? Fences may not exceed 42 inches height from existing grade within 25 feet of the front yard property line. In the case of fences on a corner lot, the clear view triangle rules apply. If you are planning on constructing a fence on a corner lot, you will need to contact the Planning Department to discuss your property’s clear view triangle.
What is the maximum fence height adjacent to a street or vehicular access easement? Fences may not exceed 42 inches height from existing grade within 25 feet of any public right of way or vehicular access easement.
Is there a required fence height for swimming pools? Yes. In ground swimming pools must be completely surrounded with a fence that is a minimum of 6 feet in height, as well as a self-latching gate.
Do hot tubs, spas, and above ground pools require a fence (and permit)? Yes. Please contact the Building Department for fence regulation specifics.
Is there anything else I should know about fences? Yes. Electric fences, barbed wire, and razor wire fences are not allowed in the City of Airway Heights, except in industrial and agricultural areas. No fence may be located in the right-of-way of any street. For further information on fences, please contact the Planning Department.
